GENERAL CONDITIONS OF SALE OF THE COMPANY BORAFLEX 4.0 S.R.L.

These conditions of sale cancel and replace the previous ones and can be varied by BORAFLEX 4.0 S.r.l. without notice.

Minimum order amount € 200.00.

The delivery terms are indicative and do not constitute a binding delivery commitment to date fixed. Any delays cannot give rise to either claims for damages or compensation, or ad cancellation or reduction of contract.

The goods are intended delivered ex works. establishment. In the absence of precise instructions from the customer, the shipment is carried out using the means deemed most suitable by BORAFLEX 4.0 S.r.l. Even if sold carriage paid, the goods travel at the risk and peril of the customer, that, in its own interest, must assert its possible reservations or reasons only in the vector comparisons.

The goods are considered accepted if no objection is raised to the seller by means of registered letter within 8 days of their delivery to the client company. They do not come complaints accepted for telephone orders as they do not take responsibility for possible errors.

Boraflex checks its products on a sample basis on the production lot. Specific tests must be expressly requested by the customer with separately quantified costs.

The company BORAFLEX 4.0 S.r.l. guarantees the regular functioning of the goods sold for the duration of 12 months from the date of shipment. The warranty entitles the buyer to replacement free in the shortest possible time, of those parts that are defective due to bad material or bad workmanship, but will not give any right to damages or compensation for people or things in any capacity, or for work interruptions.
The guarantee agreed herein is absorbing and replaces the legal guarantees for defects and discrepancies and excludes any other possible liability of Boraflex in any case originating from the products supplied; in particular, the buyer will not be able to make other requests for compensation for damage, price reduction or termination of the contract. Once the guarantee has expired, no claim can be made against the seller. The seller cannot be held liable to the buyer for any loss of profit, inactivity, non-production, loss of contracts or for any other indirect or consequential damage. The warranty is void for those parts found to be defective due to bad assembly, or improper use, or due to different operating conditions from the project specifications reported in the technical data sheets.

All returns for any reason must be authorized by BORAFLEX 4.0 S.r.l. and they will have to always delivered free of any expense to the Sordio office with a regular delivery note. BORAFLEX 4.0 S.r.l. having ascertained the conformity and integrity of the return, it will issue a note of credit equal to the sales value of the goods, reducing it by 20% for reimbursement of expenses accounting and logistics. This curtailment will not apply to goods recognized as defective for bad material or bad workmanship.

All payments must be made according to the conditions and methods agreed upon in the order. In case of late payment, BORAFLEX 4.0 S.r.l. reserves the right to apply the interests of the 2% per month as compensation for damages and without notice, starting from the time of delay, as well as, to charge all the resulting costs and charges for credit recovery.
10.
The Court of Lodi is competent for any controversy.
